your-ground law allowed him to fatally shoot a neighbor after an argument
about a party has been convicted of murder.
HOUSTON (FOX 26) -
A former firefighter who claimed self-defense in the fatal shooting of a
teacher, was found guilty of murder by a jury Friday evening.
What happened that night is pretty clear, at least to prosecutor Donna Logan.
"This is a case of a neighborhood bully armed with a CHL an arsenal of
weapons, a knowledge of the law, and he takes those things to a neighbors to
make them do what he wants them to do," Logan said to the jury during
closing arguments.
Some of the basic facts of the case are not in dispute thanks to the video
shot by defendant Raul Rodriguez. On the night of May 1, 2010, he grabbed a
cell phone, a flashlight, a video camera and his .40-caliber Smith and
Wesson pistol and walked two houses down to confront neighbors about a noisy
Karaoke party.
He got in a confrontation with several of the party goers. He drew his
pistol but then re-holstered it. He called police and told them he was in
fear for his life. One of the partygoers laughed loudly and stepped into
the street.
Rodriguez opened fire, shooting two people including homeowner Kelly Danaher
. Danaher died at the scene.
Rodriguez's defense attorney says it was self defense. He says Rodriguez
was in fear for his life. It was dark, he was outnumbered by a group of
belligerent drunks, and one of them charged him.
He says Rodriguez went down there to get peace and quiet, not to murder
anyone.
"This is a common sense thing. If you are going to kill someone, you don't
bring a video camera," said Neal Davis. "You certainly don't call police
and tell them contemporaneously what's going on."
But prosecutor Kelli Johnson scoffed at the idea that he was in fear. He
started the confrontation, he had the power to end it, he was the only one
with a gun and he hated Danaher.
He also threatened the group with a gun. They are the ones who had the right
to self defense, not him.
"That's his perversion of the self-defense laws. I'll provoke, you react, I'
ll get to fire. That's not what stand your ground is."
The jury began deliberating around 1:30 p.m.
