我们又打算10月初回国，请问我老婆在10月1号之前能否申请H4? 一旦她quit job,H1b
如果失效了，是不是一天都不能在美国待了？如果她申请了H4,在还没approve的情况下

it makes no sense to file H1 to H4 petition.
Maybe an H1 to B2 will be better for her. The key will be the H1/H4 visa
interview in China in October. | r******g
发帖数: 149 | 3 Ok, H1 to B2 is confusing to me, coz I never heard about this case before.
It is true my H1B will not be activated until Oct., but I think you can
still apply for H4 before that date, which is the same case as that when you
apply for H1B, some spouse will apply for H4 at the same time. My guess is
that even if your H4 application is approved, it will still be in effect
after Oct.
But of course the above is just my own shallow understanding. Need to be
confirmed. Also, I am not sure if I can file the H4 application in US and go
for H4 visa interview later in China.
