I am currently on H1 non-cap visa. I was planning on starting working for
company A on Oct 1st, who has obtained H1-cap visa for me. Due my very
recent knowledge that company A does not sponsor GC, I have decided to
accept an offer from company B. My question is, do I have to ask company A
to withdraw their H1 petition before company B file a new H1. Or can I
simply ask company B to do a transfer, setting the start date just a few
days later than Oct 1st (is O | e****s

have not started the position until Oct. 1, 2010, A can withdraw your H1
petition. B can file H1 for you under "new employment".
But if your H1 with A has been approved, it might be your best interest to
talk to the boss of co. A if they could apply Green Card for you in near
future.
H4 is associated with your H1 under the circumstances of your H1 is valid
and husband/wife relationship. If you lose your H1, your spouse's |
