After 3 years waiting, my Perm was denied.
My campany is small. HR is very slow to work on my EB2 through PERM.
However, they will do it again.
Our company will start PERM again next few weeks (I'm not sure, becuase they
are very slow).
I just worry that my PERM will be denied again. So I want to do NIW by
myself.
But as the laws say that we can't file EB2-PERM and EB2-NIW at the samme
time.
What should I do?
I'm frustrated.
Any comments and advice helps.

发帖数: 76 | 3 one of the lawyer said that I can let our company start PERM application,
because wage, advertisement need two or three months.
When I submit PERM application, it will take four months. When ad is going
on, if there are American applying for this job, you have to cancel it and
redo the ad again, it may take another few months.
As you know, time flies. I can't wait.
He suggested that I can submit I-140 for NIW. If my case is approved, I can
redraw out of my PERM applicaiton.
I don't know whether it is true or not?
Any suggestions?

I cannot give you suggestions since I dont know if NIW and PERM can be filed
at the same time.
However, you can start the same process.File NIW and prepare PERM at the
same time. If your NIW is approved, then stop the PERM, otherwise, submit
PERM immediately. It just save your time.
