Petition Letter如何写？答案其实就在I-140的instructions里。下面以EB1B为例。
Petition Letter的目的是什么？就是证明你和你的公司够格。所以，Petition Letter
其实是一篇论文。你要证明你够格 AND 你的公司够格。
如何证明公司够格？I-140的instructions说得明白，你得证明下面三个分论点：
A. The company employs at least three full-time researchers.
B. The company has achieved documented accomplishments in an academic
field.
C. The company has the ability to pay the proffered wage.
如何证明你够格？I-140的instructions说得明白，你得证明下面三个分论点：
A. Dr. xxx possesses at least 3 years of experience in research in the
field of xxx.
B. Dr. xxx has been offered a research position on a full time permanent
basis.
C. Dr. xxx is recognized internationally as outstanding in the field of
xxx.
前五个分论点都容易证明，所以后面讨论的重点落在这最后一个上。
如何证明Dr. xxx is recognized internationally as outstanding in the field of
xxx？I-140的instructions说得明白，你得证明at least 2 of the following 6分论
点：
1. Receipt of major prizes or awards for outstanding achievement in the
academic field;
2. Membership in associations in the academic field that require
outstanding achievements of their members;
3. Published material in professional publications written by others
about the alien’s work in the academic field;
4. Participation on a panel, or individually, as the judge of the work of
others in the same or an allied academic field;
5. Original scientific or scholarly research contributions to the
academic field; or
6. Authorship of scholarly books or articles in scholarly journals with
international circulation in the academic field.
值得注意的是，上面这个排序是很有讲究的。位置越靠前，论点的价值越高。举个例，
如果你论证了1和2，那么两个论点就足矣。但如果你只证明了5和6，两个论点或许就不
足矣过关了。
为什么呢？让我们仔细琢磨一下I-140的instructions。实际上，这6个分论点不是目的
，只是手段。我们的终极目的是证明Dr. xxx is recognized internationally as
outstanding in the field of xxx。注意这个词“outstanding”。它的意思是“1.
Standing out among others of its kind; 2.Superior to others of its kind.”所
以它是一个和其他人比较的结果。如果某个分论点就是一个比较的结果，那它的价值就
自然高了。如分论点1，major prizes or awards，奖是优胜劣汰的产物，是评选委员
会比较的结果，所以排名第一。分论点2，Membership … require outstanding
achievements of their members，这个会员可不一般，视作Fellow比较恰当，是
associations精心挑选的产物，也是比较的结果，所以排名靠前。因此一般的协会的
member 自然就是不够格的。至于论点6，大家都是信手捻来，只可惜不是比较的产物。
论点5，同理。正是由于这个原因，移民官们多次在RFE中提醒我们，“Please provide
evidence that sets the beneficiary apart individually as an internationally
recognized outstanding researcher compared to all others in the respective
academic field.”
总言之，I-140的instructions是不可轻视的宝典。 它订下了Petition Letter八股文
