以下是我的理解，我不是专业人士，仅凭自己掌握的信息和判断。
你因为没有申请post-OPT, 而h1b已经在8月中旬批准，但是10月1日生效，中间的gap,如
果有post-OPT，那么应该自然从F1过渡到H1b, 但是因为你没有申请opt, 一旦你
graduated了，从你graduated那天起，你不能用CPT,因为不是F1身份（因为已经毕业，但是又没有opt帮你延期F1身份)
。而如果你毕业日期早于10月1日，那么从你毕业的那天到10月1日之间没有身份(因为
h1b在10月1日生效), 必须离开美国，然后再签h1b入境。
另外，h1b批准日期对于你的身份没有影响，有影响的是h1b生效日期和你的F1毕业日期(就是你不能再开I20,CPT等的日期，或者是post-OPT结束的日期).

For OPT, I know that Cap Gap is perfectly okay to cover the gap for the H1
applicant as F1, till H1 is in effect on Oct 1. I used it.
However, for CPT, it's not approved through the immigration office. It is
approved by school, and the CPT should be the same as regular F1.
Is it possible that your school can extend your F1 till the end of Sept, by
your registering some credits, etc? Otherwise you are really out of status,
and your H1 change of status may not be approved.

from Aug to the end of Sep. That's perfectly okay.
As a H1 visa holder, you can study full time or part time, so you can finish
your degree later, if it's needed.
With your F1 status safe, your H1 application should be okay.

态能够到10月1日，不知道你怕啥啊?
你H1B生效之后，你就是公司的员工了，你就不再是学生了。当然你可以PART TIME做学

10月1日之后，H1B生效，在公司工作，去学校把全日制学生改为PART TIME。
我不知道有什么好纠结的。

我2011年10月1日才可以以H1B正式工作，我现在用的是CPT工作！CPT是term by term的
，是要每学期申一次的！我summer的CPT下月就到期了
我转学是因为我想一边工作一边选一二门课上，而且原来的学校离现在的公司太远，开
车要9个多小时，所以才要转学的。
如果不办H1B要想没毕业前工作我就得用CPT，而用CPT是每个学期都要交钱的，办一次
交一次的钱。我要是想工作最好的方法是办H1B

school would say that you are H1 from the approval date. For them, you are
mostly H1 to attend their school. They don't want to deal with the hassle to
change your status, and they are probably rightly to do so.
As to CPT, people can do it up to 11.5 months if not to want to invalidate
their OPT (12 months CPT will invalidate the OPT). I don't see why you can't
do more CPT. You should be able to do the same course again, or ask around
how your department is handling this. Well, when will you leave your current
school? Your CPT won't go beyond your leaving date though.
If you want to be sure, try to ask some experienced lawyers. Paying for an
hour of their time is well worth the risk you might take.

will be H1B.
If you are a registered F1 student and you satisfy all the requirements, for
example, credits, money, etc, you should be able to reapply for CPT or
extend the CPT. But once you are no longer F1 but H1B, you don't have the
privilege to use CPT or OPT.
Theoretically you will still be F1 until OCt.1st, but maybe your school has
some requirement for the eligibility to appy OPT or CPT, for exemple, have
already registered for one semester or accumulated certain credit. SInce
you transfered to a new school, it may complicate it.
it could have been easier if you didn't mention your H1B, to cover this
three-month gap.

能选CPT的课只有一门，与我现在选的是同一门！
同一门课我能选两次么？

For our school, we didn't even need to register for a class, but just to
get an approval letter from the department, and then get it processed in
the international students' center. We'd register for a common non-
credit course as an evidence to be a full-time student, which applies
for both CPT and/or other near-graduation status.
Whatever way you'd go, you should be able to get more CPT time, though,
because we can get up to 12 months of CPT.
People here are concerned whether you have told your old school that you
will apply for H1B. If not yet, you should not let them know, at least
not until your CPT is extended.
Well, we are not lawyers, I am still not sure about the following
things:
1. Will your CPT expire the day you transfer to the new school? As
theoretically your CPT is approved from your old school. Can you enroll
in the new school as a part-time student, while also keeping a part-time
student status in your old school? Or, are full-time student status in
two schools okay?
2. In H1B application, a graduation certificate is often required to
match up with the job position, etc. Do you need your graduation
certificate from your old school for this purpose? Will your H1B
application influenced in any way by your student status? If the degree
certificate is not needed, then your H1B application should be safe.

我还没有告诉旧学校我在申H1B
我一旦transfer到新学校,旧学校的CPT应该是expire 的。我不太可能成为两个学校的
学生吧，因为我就一个sevis，这个我还真不知道！
我申H1B主要用两个国内的文凭申，美国在读的会计只是做辅助，就提供成绩单/I-20什
么的：）

You are most welcome! I think that I am following through as I also want
to know how your complicated case will turn out. :-) I wish it work out

The worst case is probably some unauthorized stay, and you can't work
during the gap, but 485 allows 180 days of unauthorized stay. (This is
totally my own babbling, I don't assume any legal responsibility here.)

That's great, so you are not bound by your old school in this.
CPT is rarely for a new student. But for a transfer student with lots of
transfer credit, maybe it's doable.
Another option might be that you could transfer school in next spring,
rather than fall, if your schools use semester system. Or is your new
school in quarter system? Then you can transfer even a bit earlier. In
this way, you are F1 for your old school, and H1 for your new school
without any gap. Can you register some credits in your old school
without physically being there for the fall? I understand that your old
school is far from your current place, and I understand that this may

out, we might be a bit intrusive to ask you for so many details. Sorry
about that. I understand that you want to transfer to the new school as it
is closer to you. Well, which school is better? If the old school is better,
and you have only some credits left to be taken, you could take some
courses in the new school but transfer those credits to your old school, of
course after thoroughly consulting about the credit transfer policies.
However, you have asked the new school for enrollment, could you still just
register for courses there though? Or if the new school is better, then
getting a degree three is a better option. Your case does sound like a big
puzzle where many pieces need to be considered together. :-) Best wishes for

人家说我approve后就是是H1！我当场晕倒！：）

发帖数: 6523 | 35 hehe, does that mean that you can start working from that approval date, or
is it just that you can stay in US legally but can't work. Either way, at
least you can stay in US with valid status then. You could ask them whether
you could still work for your current company before 10/1, and there could
be some leeway for such gap time (it's totally my speculation). With H1, you
can still go to school, now the new school is of course the better choice.
I hope that your H1 will be approved as soon as possible, before the end of
Aug then. :-)

是的,至少我不用离开美国.其实如果H1申不下来我也不用离开的,因为我还是F1.
