September. And the F-1 OPT I-20 form which shows the 60 days grace period.
But, you stay illegally too long time, your F1 expire May, it took you 4
months to submit F2 application, I can only say you are too crazy. |

some receipts. My opt expired May 31 that year. I submitted my application
for status change from F-1 to F-2 about Sept. 2 or 3 and it was approved in
Oct. I remember the grace period was three months.
Between May and Sept. I also submitted H1B application and got denied.
Anyway, thanks for your answers. |

applied, since you could stay legally if you submit these applications.

Then,you had legally status between your H1B application and deny.
Did you submit F1-F2 application before you get H1B deny? If yes, no gap.

More than 180 days, u are in trouble
If u go out of US and get another visa back, the above 2 cases are fine

if no, I would suggest you to find a good lawyer first and bring all your I-
797 receipts, approval/denial notices to see him/her. Good luck!

that period", no need to file 245(k).
if didn't left US and applied a visa re-enter US, and <= 180 days, need to
file 245(k).
if didn't left US and applied a visa re-enter US, and > 180 days, have to
leave US, otherwise may be rejected.
"A foreign national who makes use of Section 245(k) normally has violated
the terms of their status for 180 days or less from the time of their last
lawful admission."

lawful admission into US. Some IO may overlook the time of the applicant's
last entry, and my post was just to reminder LZ about this.
Anyway, I don't think there are any other regulations other than 245(k) can
help with such a case.

法打工. 从你写的来说, 你确实OOS超过180天了.
看来这个IO是盯上你了, 也许律师可以帮你...(虽然我觉得这个也很难).
如果在交485前,出境一次再取得签证回美, 基本就可以把你以前的OOS洗白了.
现在只有看你运气了, Bless !

其实，在转身份期间应该是可以合法呆在美国的
只不过你之前的合法身份过期了一两天。。

算与不算, 你得找出条款来. 你申请H1B已经在OPT GRACE PERIOD之后了.我也搞不清你的OOS如何来算.
我同意了, IO不同意也不行呀.

发帖数: 3862 | 27 我觉得楼主的情况很复杂，说实话很危险，要认真对待，还是找个好一点的律师把。
在美国保持合法身份的关键是，每一个身份失效前，要提交下一个转换身份（COS）的
申请，要环环相扣，对于最后485的影响是，身份失效不能超过180天 （使用245k）。
这个case相当于三个环，F1-〉H1B-〉F2，关键是环扣上了没。
我的理解是，
首先，H1B的申请(9/2)已经晚于OPT的grace period (8/30),严格来说身份已经开始失
效，H1B pending 期间不能算合法，所以一直到F2开始之前都是unauthorized stay。
这个环没有扣上。
第二，按照皮匠的说法，在第一个申请pending时提交第二个申请，如果第一个申请批
准了，那没有问题，但如果第一个申请被拒，那么第二个申请也会变成无效。楼主在
H1B pending时交的F2,H1B后来被拒，严格说这个F2也有问题，但是移民局自己批的事
情，应该不会去追究了。
如果楼主能证明H1B申请是在opt失效之前就提交，可能还有些帮助。
当年如果回国签F2的话， 曾经的身份失效可以抹去，这个时候还是找个好的律师吧，
回复这个RFE很重要，后果可以很严重。
我不是想危言耸听，只是想让楼主知道可能的最坏结果。当然希望你们顺利解决这个暂
时的问题，早日拿到绿卡。
