Her LD's case appeared to be very strong, and his being H4 was temporary due to family reasons. He was working before he filed 140, and he had an offer when he was on H4, but their H1 processing was too slow, so he filed 140 while on H4.
If you have your reasons, such as family reasons, and best yet if you have an offer in hand, you could justify it.
