And this should not affect 485
However, the reason provided by the last two stories are not right.
Even if you are allowed 180 days gap , you must have a valid status at the
time you submit 485. If not, 485 can still be denied.
In your case, your LD has a valid status because he/she submit 485 before f1
grace period expires.

unemployment. You ARE violating the terms -- the terms of maximum number of
days of unemployment under OPT.

However I PERSONALLY do believe that the 60 day grace period would apply
each time you have an F status expiring.

It is therefore taking your own risk to assume one has a valid status after
90 days of unemployment . It is not clearly stated in law and is therefore
up to IO's discretion.

OPT开始的前几天没有工作，后来有工作，中间又有一段时间没有工作，后来又找了个
工作，又只工作了几个月，后来转dependent了……
整个时间就是： 无工作1+有工作+无工作2+有工作+无工作3 = 1 年OPT（365天）
其中：无工作1+无工作2+无工作3=90天
当年我的OIS的advisor是这样说的：
说我上面的情况因为除了90天其他时间（（365-90）天）都有工作，这样我OPT结束后
就有60天的grace period，我可以在这60天提交转身份申请并保证在这期间收到
receipt就可以。
如果是： 无工作1+无工作2+无工作3 > 90天, 譬如91天，她说我就没有OPT结束后60天
的grace period……如果在那90天之内没有提交转换身份的申请并收到receipt，应在
第91天的那天必须立即离境。
我后来觉得这90天也太玄了点，虽然我的刚好是90天，可是万一数错了一天岂不是得离
开……所以我就没有再等另一个工作的回复，直接就在“无工作3”的那段时间也就是
90天之内就提交了转dependent的申请并在其内收到了receipt……

发帖数: 47 | 10 谢谢大家的回复和信息，看来结论是OPT超过三个月无工作的话还是会有问题的，那么
如果学校的OIS还没有上报的话，是不是USCIS就不知道现在的身份非法了？在这种情况
下，一般审理485时会要求副申请人提供工作证明吗？
好像听版上有人说485的副申请人不需要提供工作证明，不知道当副申请人在OPT超过三
个月时会不会被要求提供，还望有知道的或者经历过的大侠们告知，万分感谢！ |
