女朋友I20过期已经超过3个月 F1还有效 下个月就要回国了
已经收到新大学的I20 这种情况下签证过的可能性有没有 还回的来美国么？
另外 如果我们在中国结婚 她还回的来美国么？ |

-20 extension prior to its expiration date. Allowing the I-20 to expire
before completing an academic program is a violation of F-1 status.

If you violate your F-1 status, you may be able to apply to the U.S.
Citizenship and Immigration Services (U.S. CIS) for reinstatement of your
student status.
The U.S. CIS may consider your request for reinstatement if you:
Have not been out of status for more than five months.
Establish to the satisfaction of the U.S. CIS, with detailed documentation,
that:
The violation of status resulted from circumstances beyond your control.
Such circumstances might include serious injury or illness, closure of the
school, or a natural disaster. Circumstances beyond your control do not
occur where inadvertence ("I did not know"), oversight, neglect or a willful
failure on your part or on the part of the Designated School Official
resulted in the need for reinstatement.
The violation relates to a reduction in your course load that would have
been within a UC Berkeley Extension Designated School Official’s power to
authorize, and that failure to approve reinstatement would result in extreme
hardship to you.
You are currently pursuing, or intend to pursue, a full course of study in
the immediate future at the school that issued you the Form I-20.
You have not engaged in unauthorized employment.
You better ask a lawyer for this issue.

有困难
很难，除非她有很多证据她会回中国

我已经是美国公民了，因为她暑假一定要回国
那如果我们在中国结婚的话能给她办临时绿卡么？
她也不想定居美国 就是想有个身份来回方便

20 expired and overstay。似乎她现在的情况还不是特别糟糕.
你最好问问移民律师，怎么操作更适合你们的情况。
