小弟遇到一个非常紧急的事情.
小弟的H1b签证今年七月一日过期, 博士后老板也没钱了,找了几个月,直到今天才有另
外一个单位的老板想雇佣我. 我的H1b既需要transfer,又需要同时延期(第一次延期).
新老板帮我问了他们的移民顾问, 他的回复如下:
"I talked to UF Immigration Compliance about the transfer of Minghui Wu. UF
cannot process any H1B less than 3+ months minimum. The H1B must be
extended by the current institution to port the H1B to UF and the foreign
national cannot have a gap between employers (USCIS ruling). Otherwise, he
would have to depart the US and reenter with a valid H1B visa, once UF
receives the H1B approval per our filing; this is referred to as a consular
filing".
不知道该怎么解决.
这个规定是general的,适用于所有大学的? 还是说是UF自己规定的? 是否用加急可以度
过这个难关?
请大哥大姐尽快回复,小弟非常焦急. | s**********l

No. I have transferred H1 many times (sadly true), none of them has those
bull shit requirement. As far as they file your transfer one day before July
1, you are eligible to work for new organization.
还是说是UF自己规定的?
Maybe, I know UIC has similar requirement. They need actual approval notice
before you can work for them.
是否用加急可以度过这个难关?
加急 cost lots of money from PI who is under funding stress. PI/school might
not like it.
My suggestion: Find a link from UCSIS stating that once H1 transfer has been
initiated, the applicant can work for new organization.
If they won't buy it, move on and find another organization that will
recognize this common sense. | w******e
发帖数: 953 | 5 There is no so-called "H-1 transfer". They have to apply for a new H-1 for
you.
But if you have H-1 already, under some act you are allowed to work for 240
day if your new H-1 is not approved in time.

发帖数: 24532 | 7 目前看你的未来的老板所属UF也应该是可以提供non-cap的H1B的，那么只要是同一性质
的transfer,在收到receipt后即可工作。 而要递交H1B 的过程，其实也是非常简单的
，你可以要求自己填所有相关的信息表格，然后发给UF ,他们填入学校的信息。一般也
2~3天即可完成。至于说要3个月，那对于另外那头的律师又不拿bonus,也就没有
incentive帮你快一点搞。
这个你和你老板说，只要有receipt，就可以开始工作，没有任何问题。

发帖数: 1429 | 8 有些学校的international office 极其官僚，2天填完的表一定坚持要3个月。
如果学校不给能在7月1号以前交上去并且拿到receipt的话，估计最快也要4个月（3个
月递交申请，2个星期pp，1个星期回国内签证，一个星期回来）才能开始上班。要是不
顺利比如被check，时间会更长。如果未来老板不愿意等的话，就只能早点move on。
以前碰到过同样的事情，极其郁闷。不过但愿你的能更顺利交上去拿到receipt。 good

三个月都是少的，有的就是要6-7个月。 他们要在UICIS之外再多加一个表，等这个批
准就两个月了。然后再post 个半个月！ |
