485转到EB1B下，485 RFE 老公的 EVL,交上去已经31天了还没消息，昨天老公老板不想
让他再上班了，最后的结果明天会知道，不过已经凶多吉少了，这种情况我们该怎么办
？虽然老公现在开始找工作，新工作而且是同领域的一时半会很难找到。我有以下几个
问题请朋友们有知道的帮忙回答一下：
1）我们的485是不是可以立马relink到我的EB3虽然现在EB3 或EB2的排期还没到？
2）我们已经有EAD卡，不过那是485 relink交上去后批下来的，这EAD卡是不是基于我
老公的EB1B 140上，他就不能用EAD卡工作要是他失去现在的工作？
3）假如明天是他工作的最后一天，是不是他就得立马转成H4身份，否则身份就有问题？
上面的问题我已经问公司律师了，不过他们还没给回复，要是有朋友知道答案的话麻烦
回答一下，多谢了！我们的情况实在太复杂，本来以为可以安心等绿卡了，没想到出这
么大的麻烦。 |

发帖数: 341 | 4 you guys are under AOS status, so his status is OK until 485 is rejected
The EAD will be invalid once his 485 is rejected before december. It is
directly linked to the current 485.If there is no decision made prior to
December (180 days), he will be safe as long as he finds another job in the
same area.
Since you have already responded to RFE, it is not likely they will RFE
again for EVL. (My guess)
I don't think you can relink the Eb1 485 back to Eb3/Eb2 140 which is
noncurrent.
He can change to H4 after he receives another RFE for EVL. |

但是又在180天之内，是不是对以后有影响（比如公民申请）？要是这样的话，是不是
最好撤销485申请？现在老公还剩几个星期的休假，他会尽量让老板再留他几个月，希
望他老板能发发善心。

Never heard of any cases who fails to get citizen because of changing job <
180 days in the past. Once you get the green card, it's done |
