RFE要求提供EVL。而现在即便是EB1A 485 pending的时间也大幅增加因此RFE的时候要
求有一份EVL的可能也大大增加。正好之前我有一点类似的经验，以前也写过个帖子详
述，不过大概也难找到了。这里再给大家说说我的经验：
1， 485 pending期间有工作上的变化，只要不是你主动去招惹USCIS说我换了，一般不
会以此为由让你提供EVL。如果被RFE了有要求提供，很多时候是因为时间太长，USCIS
想确认你是不是还在本领域工作。
2，如果是EB1A，理论上讲你不需要一个永久位置来保证你的绿卡，但是你需要证明你
随时有意愿有能力在相同领域工作或迅速找到工作。所以EB1A在485期间换工作，失业
都不是什么大不了的事情。
3，既然如此，为啥USCIS还要EVL？是为了证明第一，你还继续在本领域工作，第二，
你不会成为public charge。只要你能证明这两点，无论你做了什么，USCIS都没法为难
你。
下面是我之前恢复RFE的时候给USCIS写的信，希望对有需要的同学有帮助。也祝左右的
同学早日拿卡。
Dear Sir / Madam,
As required by the USCIS office, I am submitting supporting evidences for my
I-485 application (Application to Register Permanent Resident or Adjust
Status). The related documents as indicated by the Notice of Request for
Evidence are enclosed with this letter.
I was working with XXXXXXX from Dec. 2008 to Dec 2014. I decided to start my
own business and left XXXXXXX in Jan, 2015. On Mar. 12th, 2015, I
officially started my own company, XXXXXXXX, which will focus on research
and providing the scientific and technical consulting service in the area of
molecular biology and cancer biology. Please be noted that as a self-
petitioner under E11 (also known as EB1A) category. I am NOT required to
have a permanent job position to warrant my application, thus the changes in
my employment status will NOT affect the eligibility of my I-485
application as long as I will continue to be engaged in the same area of my
extraordinary ability.
Enclosed please find the following documents:
1. Photo copy of the Employment Verification Letter from XXXXXXXXX to
prove that I was working in the same area of extraordinary ability as in my
I-140 petition while the I-485 application was filed.
2. Photo copy of the last paystub from XXXXXXXXX to prove that the
position was real and I was never a public charge.
3. Photo copy of the documents of the formation of my own company,
XXXXXXXX, to prove that I will continue to be engaged in my area of
extraordinary ability as in my I-140 petition.
4. Photo copy of the bank statements of my financial status to prove that
I am NOT a public charge while I am starting my own business.
5. The properly completed and signed Form G-325A, Biographic Information
Sheet.

但是已经很难证明是对美国的贡献。。用国内的EVL回复485 RFE是否可以？？ |

发帖数: 1553 | 4 这个在本领域内工作还是得在美国，拿国内的EVL可能没啥大用，除非你这是跨国大公
司在国内的branch能证明你只是暂时性的在中国工作。

司在国内的branch能证明你只是暂时性的在中国工作。

我觉得以防被质疑是否还在同领域 大家可以继续审稿（当然绿了可以回馈板上） 保存
各种invitation 证明还在贡献 最好还能继续发文章（assume你是scientist position

的呢？刚开的公司如果没有收入怎么办？
