其中第1面提到
"Finally, this rule includes a requirement that aliens seeking an extension
of stay or change of status demonstrate that they have not, since obtaining
the nonimmigrant status they seek to extend or change, received public
benefits over the designated threshold, as defined in this rule."
第16面提到 "Additionally, this rule contains additional provisions that will
render certain nonimmigrants ineligible for extension of stay or change of
status if she or he received one or more public benefits for more than 12
months in the aggregate within any 36-month period since obtaining the
status he or she wishes to extend or change."
本人多年前是F1学生,老婆F2陪读,期间老婆陆续生了两个娃. 那时候一贫如洗,学费
生活费勉强靠奖学金支付,没有多余的钱给老婆买孕妇医疗保险,只能向政府申请了
Medicare aid , 3年中总共时间可能超过12个月了。更麻烦的是,那时候本人是以
household owner的名义填的申请表,于是政府工作人员糊里糊涂把本人名字也列在受
益人上面; 其实本人当时有学生医疗保险,本人并未用过Medicare aid, 当年也没太
在意。
本人以opt 工作后转成了O1, 又申请了EB-1B 140获批,处在排期中等待提交485. 485
是change of status . 本人注意到这个public charge 的more than 12 months in
the aggregate within any 36-month period 是从 since obtaining the status he
or she wishes to extend or change 算起的。 那么本人目前是O1, 想用485 来
change of status ,是不是之前F1 申请的Medicare aid 就不算public charge 了?

DHS will not consider the Medicaid benefits received:
For the treatment of an “emergency medical condition;”
As services or benefits provided in connection with the Individuals with
Disabilities Education Act;
As school-based services or benefits provided to individuals who are at or
below the oldest age eligible for secondary education as determined under
state or local law;
By aliens under the age of 21; and
By pregnant women and by women within the 60-day period beginning on the
last day of the pregnancy.

program and the state-only funded health insurance program, aliens are not
required to report the receipt of the state-only funded health insurance.
However, if Medicaid is listed on the Form I-944 as a received public
benefit receipt, it is the burden of the applicant to provide information
and documentation that the health insurance is state funded only. USCIS
assumes that any Medicaid identified on the Form I-944 is federally-funded
Medicaid.
你作为没有绿卡的人不可能拿到其他的medicaid。
