现在是i-140 已经approval的faculty， 博后A学校用了一年的h1b, 然后现在B学校第
一个三年h1-b马上到期正在准备renew.
h1b正常是6年是max， 但有approved的i-140按理说 （i-485没有current的话） 可以
一直renew
我的问题是， 这次我renew应该是得到2年的h1b 有效期, 还是直接可以又是3年？
顺便给非理工的faculty一点信心。 pd 是2019中的， 早就可以办， 各种原因自己拖
拖拖 （然后现在情况越来越糟 哎。。。）. eb1b 批的时候 citation 不到150，
review接近30个， paper 15篇左右， 一半一作， 基本都是行业top 10% 的journals
， 推荐信5封， 全是美国的 （其实准备的时候也没太当回事， 没想着找国际的），
一个national academy fellow （不知道是不是就是大家叫的院士？）， 一个以前联
邦政府的副部长 （现在退休在本校挂着职）， 两个行业最大协会的 chair， 一个行
业巨大牛（本校） （个人觉得行业大牛其实dhs的人也不认识， 不知道是不是真有用
我是照着能找到最牛的人的思路去找的， 不一定对其实）
各种理工数据我觉得非理工专业的朋友仅供参考 pp了然后一周不到回来的
回到重点： 这次我renew应该是得到2年的h1b, 还是直接可以又是3年？ 谢谢 要是

contains a request for an extension of stay that reaches the maximum 6 year
limit. USCIS adjudicators should first determine the amount of H-1B
extension time that may be granted to reach the 6-year limitation of stay,
then determine if the labor certification or I-140 petition was filed at
least 365 days by the conclusion of
the 6-year limitation of stay in such instances. If so, then the one year
AC21 106(a) extension may be granted. However, in no case can an extension
be granted for more than a three-year period of time.”

status if the alien is the beneficiary of an I-140 petition and would be
eligible to be granted immigrant status but for the application of per
country limitations applicable to immigrants under INA § 203(b)(1), (2) or
(3). Despite the title of AC21 §104(c), referring to “one-time”
protection, USCIS may grant such H-1B extensions, in a maximum of three year
increments, until such time as the alien’s application for adjustment of
status has been processed and a decision made thereupon.
AC21 § 104(c) is applicable when an alien, who is the beneficiary of an
approved I-140 petition, is eligible to be granted lawful permanent resident
status but for application of a per country limitation to which that alien
is subject or, alternatively, if the immigrant preference category
applicable to that alien is, as a whole, “unavailable”. Any petitioner
seeking an H-1B extension on behalf of an H-1Balien beneficiary pursuant to
AC21 §104(c) must thus establish that at the time of filing for such
extension, the alien is not eligible to be granted lawful permanent resident
status on account of the per country immigrant visa limitations or,
alternatively, because the immigrant preferenceclassification applicable to
the alien is “unavailable”.
In order to make a determination as to the H-1B alien beneficiary’s
eligibility for an extension of H1B status under the provisions of §104(c)
of AC21, USCIS adjudicators are instructed to review the Department of State
Immigrant Visa Bulletin that was in effect at the time of filing of the
Form I-129 petition. If, on the date of filing of the H-1B petition, the
Visa Bulletin shows that the alien was subject to a per country or worldwide
visa limitation in accordance with the alien’s immigrant visa “priority
date”, then the H-1B extension request under the provisions of §104(c) of
AC21 may be granted. To establish the alien’s priority date, USCIS may
accept a copy of the H-1B alien beneficiary’s Form I-140 petition approval
