Under current procedures, because H-1B cap numbers are allotted per alien,
and not per petition, no adverse consequences befall a petitioner that seeks
to exploit the system through filing multiple petitions. By statute, USCIS
may only allot one cap number per alien beneficiary, regardless of the
number of petitions that were filed on the alien’s behalf.
