一个公司给offer，
本来已经开始办新的h1b了，打算10月出开始
今天收到公司hr的email：
xxx（律师） just informed me that your H-1b is subject to the cap. With
that said, you can start sooner with us (ether upon filing or with the
approval notice) rather than in October.
这是怎么回事，
是律师搞错了吗？ |

发帖数: 4430 | 7 这个没有错误。不管你是CAP的， 还是不是，现在上班都是可以的，当然不是的话，必
须开始申请CAP的H1B，在申请到之前你是可以上班的。 这个不叫TRANSFER， 你的情况不能
TRANSFER。 这个叫H1B PORTABILITY， 对CAP不CAP都适用。
