If you know for sure your employer won't revoke your I-140, you can transfer

and extension will be done at the same time. I am 7 years in my H1B.
However, you have to start over your immigrate application from PERM. But it
does not matter, you can carry over your PD and it takes less than 1 year
to get new 140 approved.
As I said, revoke will not affect your pd unless your employer admit that
they cheated when submit your I140. I believe no employer will do that, so
you are safe. My lawyer is the top ten immigration lawyer in local area and
she
told me that. Find an experience lawyer to help you.
What some guys said about revoke and PD are very misleading, they actually
don't have any experience about that, just speaking without doing research.

子,新公司又等不到原来的H-1B延期。我是不是就能够用原来公司的140去做H-1B
transfer,同时再延期呢?
另外一个问题,我公司的律师说140批了之后是寄到她那儿,不会寄给我,我可以用什
么理由去要这个140呢?

l**b 发帖数: 457 | 26 这个怎么还拿出来啊,有很多人到现在还不理解这个,I140批准以后,PD就是你的东西
了。一般来说,可以直接找HR要I-140的Approval Letter,这个是个HR都会给,不给原
件,你要复印的就可以,只要有case no。就可以re-link你的PD的。这个USCIS专门有
一个memo,我找到了一个原版的复印件。什么revoke I140,那都是乱说,和前面一个
大牛说的一样,除非employer承认他帮你办I140的时候cheat了。要不然,根本不可能
有人没事去revoke!
你I-140下来了以后,换工作,等于I-140失效了,但是PD没有失效。重新弄PERM和I-
140就可以了。
USCIS的memo的no是HQPRD70/6.2.8,
原文上面的话是:
Determining the Priority Date. In general, if a petition is supported by an
individual
labor certification issued by DOL, the priority date is the earliest date
upon which
the labor certification application was filed with DOL. In those cases where
the
alien’s priority date is established by the filing of the labor
certification, once the
alien’s Form I-140 petition has been approved, the alien beneficiary
retains his or
her priority date as established by the filing of the labor certification
for any future
Form I-140 petitions, unless the previously approved Form I-140 petition has
been
revoked because of fraud or willful misrepresentation. This includes cases
where a
change of employer has occurred; however, the new employer must obtain a new
labor certification if the classification requested requires a labor
certification (see
the section on successorship of interest). |
