在6.7说道即使不答辩也可以申请17个月的延期（May apply for the 17-month
extension if otherwise eligible，这个不知道我是不是理解的有问题）， 但在紧接
着的6.8又说道如果头12个月内不答辩的话要换身份或离境（这个跟学校iso的说法一致
）。
我的问题是，如果我不能在这头12个月内答辩的话，到底还能不能申请那17个月的延期
呢？本来不想问这个问题，不过答辩在老板那里一拖再拖，心里没底呀。。。 |

Hi,
One of my friends happened to find a comment regarding STEM OPT
extension which seems new to me compared with what I learned in April/May
last year when I was striving with my legal status and received a lot of
help from you.
In short, this official comment states that a STEM major student who
does NOT finish degree requirement in 12 month of his OPT is still eligible
for 17 month STEM OPT extension.
I am not sure whether you are already aware of this but it should not
hurt to send below link to you:

You are correct, chenpp. School officials received clarification that to
issue the 17-months recommendation, they do not have to require proof that
the student was completed his/her degree requirements during the 12 months
period of the regular OPT.
This condition still exists, but verification that the student fulfilled the
condition is now the sole responsibility of USCIS.
Sorry that these clarifications were sent out after I gave you a hard time ;
-), but at the time when I processed your extension request, that
clarification had not yet been issued.

这个回复和我发的信中给出的那个指导意见有一点一样，即ISS发17个月STEM OPT I20
的时候不需要检查学生是否已经满足毕业要求，即学校不会在I20上卡你；有一点不一
样，即ISS认为USCIS还是会查学生是不是毕业，不毕业不会批；而指导意见认为只要有
post-OPT并且没有违反其他条款（就业和地址变化、失业天数），不论学生是否已经毕
业，USCIS就应该批准该学生17个月的OPT延期申请。
如果说学校在这事儿上卡你的话，可以把信里的链接发给他们。注意这个指导意见很新
，去年十月底出来的。我去年这个时候办这事儿的时候还是说12个月没毕业就没有STEM
OPT的。
但是不论如何，尽早毕业是王道。
