Jan 11, 2016 – Wash Tech filed motion asking court to not grant the
extension requested by DHS.
At this time we don’t have an official confirmation from DHS on the
validity of STEM OPT Extension beyond Feb 13, 2016.

•It claims Dec 14, 2016 was deadline for DHS to have published the
rule.
Some excerpt from the document that you MUST Read:
“The Court gave DHS a six month delay to mitigate the effect of the vacatur
order and DHS still has not bothered to notify those affected that aliens
will not be able to work on OPT extensions after February 12, 2016 or told
them what their options will be.” (Page 14)
When DHS requested the Court stay vacatur, it clearly stated that aliens
would not be able to work on OPT extensions after a vacatur and that,
without such a stay, such aliens would have to “scramble to depart the

it will shake many main companies, however, the impact for the court itself
to grant or not grant the extension is nothing, so only the fool will not
grant.
But there are definitely a lot of fools, so even the court does not do the
right thing, it is just a district court, I believe routinely DHS can appeal
to the Appealing court which is one level higher than the district court,
then more time will automatically be granted to wait for the appeal result,
and DHS should by any means have enough time to finish their job then

impact is huge
Secondly, by law DHS can appeal to the Appealing Court to solve the time
issue, then this is just a technical issue
