标 题: Job changing and AC-21 green-card appplication porting

Here is my situation. My 140 has been approved for 4+ years. 485 has been
pending for 3.5 years. Now a new company would like to make me an offer.
This company would like to confirm the portability first before making the
official offer. I already gave them the approvals for H1B, EAD, AP, and
receipt of 485. However, they would like to see the PERM labor certification
and 140 approvals, which are hold/owned by my current employer. Obviously,
I don't want to let my current employer know that I am looking for a new
employment.
If you have changed job with 485 pending, can you share your experiences/
comments? Also when you actually port the green-card application to a new
company after accepting the offer, do you have to get the labor
certification and 140 approval from your old company? Can you share some
details about the porting process? |
