I have to appeal in a small court in a couple of days later, I really
appreciate you can help me on this - If a patient called a doctor's office
and made an appointment with the physician. Without any notification from
the office, if it is legal for physician's assistant instead of the
physician diagnose the patient? (Because this physician's assistant wrong
dignosis, my situation got from bad to worse. I had to visit another doctor
two days later and got new prescription)

Was the doctor negligent in delegating his/her duty to the assistant? (suit
against doctor for pure negligence or negligent entrustment)
Was the assistant negligent? (suit against doctor under vicarious liability,
or against assistant for pure negligence).
