包装侵犯了他们的COPYRIGHT，我看了一下，颜色设计是差不多的，但是文字LOGO等等
差别还是挺大的，文字上雷同的很少。
据说在中国，3个地方不同就不算侵权。在美国，请问这种外包装COPYRIGHT是怎么算的？

对方主要是说外包装的文字，图片，2D设计是有COPYRIGHT的。
如果我事先对此一点不知道，对方通知我后我立刻停止销售，还算侵权吗？

registrations for text, graphics, and other designs, then any substantial
similarity on any single federally registered copyrighted item may be
infringing.
the question of substantial similarity is a tricky one--you'll need to
consult a copyright lawyer if you really are concerned.
past infringement has nothing to do with whether you stopped--but if you
continue after getting notice of infringement, it might count toward willful
infringement, which warrants a higher damage amount. but again, who knows
what they'll do. Consult a good copyright lawyer just in case. |
