法律条文里写：
（2）Prior to accepting payment, the towing company shall keep one copy of
the photograph taken pursuant to this paragraph, and shall present that
photograph and provide, without charge, a photocopy to the owner or an agent
of the owner, when that person claims the vehicle.
意思就是取车付款前，应该给车主看车被拖时的照片，并给一个复印件。
可是在取车前，楼主打了电话主动要照片和general authorization.拖车公司用email
只发了照片，楼主也看到了照片，然后去取车。看照片的地方不在取车的地方。取车的
地方看门人不是接电话的人。取车的时候，看门人没有给楼主照片。楼主录下了取车的
过程。
这样打官司能赢吗？ | g******g

of a vehicle at the towing company’s discretion shall not be delegated to a
towing company or its affiliates except in the case of a vehicle unlawfully
parked within 15 feet of a fire hydrant or in a fire lane, or in a manner
which interferes with an entrance to, or exit from, the private property. (
ii) In those cases in which general authorization is granted to a towing
company or its affiliate to undertake the removal or commence the removal of
a vehicle that is unlawfully parked within 15 feet of a fire hydrant or in
a fire lane, or that interferes with an entrance to, or exit from, private
property, the towing company and the property owner, or owner’s agent, or
person in lawful possession of the private property shall have a written
agreement granting that general authorization.”
意思是拖车公司一定要有General authorization，才能从我住的小区拖走我的车。可
是HOA说虽然是private property,但是街道是city的。
如果拖车公司说他们可以从city的街道上拖车，我怎么反驳？
小区的入口处都有标志，写着public parking prohibited。而且列出了拖车公司that
has a general authorization with HOA. 上面没有拖我车的公司。 |
