一般来说，对于犯罪，既适用属地管辖，也适用属人管辖。 如果犯罪行为发生于美国，
（不论犯罪人受害人国籍）美国法院就具有管辖权。所以直接报警就可以了，自然由美国
的检察官依据美国法律起诉犯罪者。如果受害人与犯罪人均是中国人，（即使犯罪行为不
是发生在中国）中国法院（理论上）适用属人原则也有管辖权，就是说，中国的检察官亦
有权向中国法院起诉犯罪人，或者受害人向中国法院提起自诉（适用于特定的犯罪行为）
使之受到中国刑法的惩处。 |
