站注册的时候
agreed term 里面约定:找他看过房子,自动将他当做buyer agent.
可是我发现他总是想我买贵房子,而且起始价格给的还挺高。发现后得两个星期到现在
,再也没有找过
他。从一开始也没签过任何paper contract of authorization
现在的问题是在他领着看得房子中有一个我比较喜欢,但我想找我另外新的并且信得过
代理人处理,请
问这样可以么?
要多久我才能和这个代理人结束代理关系。

yes he did send to me information on similar houses sold in this area and
suggested me offering a high price close to listing price.
i rejected it and gave him my reasons. and Now the price has dropped

该他拿Commission。但是实际上都是谁帮你出Offer,谁去拿Commission的。

he will know who the buyer is.

When you bought it, he will know it sooner or later. Also, he can let you
pay him the agent fee. Or everyone can kick off the agent after seeing the
right house and deal with the owner directly.

"Procuring Cause" 上。
Procuring Cause 大意是指最开始是由哪个Agent 把 Buyer 带进这一笔交易,之后又
有没有 follow up 的 events 导致这一笔交易最后成交。
当有 Agent2 出现的时候,他是否知道 Agent1 的存在,以及 involve 的企图(比如
纯粹要 hijack commission;或是 Agent1 breached buyer's trust and fiduciary
duty),也是判断谁是 Procuring Cause 的关键。
单单提供房地产信息并不能决定 Procuring Cause。不然他把所有市场上的信息全传给
你,他岂不是一定做成你那笔生意? =)
以免麻烦,如先前所说,用书面和 email 通知你那 agent,你要换人。
很多在法律上说不通,但要经过法律程续就太费时失事了。 |
