糊涂了。
下Offer了。Agent起草了了购房Contract和EXCLUSIVE BUYER AGENCY CONTRACT（之前
听说最好不要签这个？？但是我的Agent说一定要签啊）。看了这个Agency Contract，
里面说Broker的Compensation是这样付的：
(a) BROKER shall be entitled to compensation, including transaction broker
situations, for assisting and/or negotiating in the procurement of Property
acceptable to BUYER. If a selling incentive is offered by Seller, BUYER
agrees that BROKER may accept same. BROKER'S fee shall be:
i) The amount shown as the "selling commission" in a multiple listing
service that BROKER is a member of, or 2.5% of the Purchase Price of the
Property, whichever is greater.
ii) In the event BUYER wishes to purchase a home that is not listed in a
multiple listing service that BROKER is a member of, BROKER will seek a
written fee agreement from the Seller in the amount of 3% of the Purchase
Price of the Property. If said fee cannot be obtained from Seller, then
BROKER shall notify BUYER in writing and BUYER agrees to either pay all of
the balance on the agreed fee at the closing of the transaction, or forego
the purchase of said home.
BUYER understands and agrees that BROKER may be compensated by more than one
party in the transaction. BUYER hereby authorizes the party handling the
closing to pay the Commission and Other Compensation to BROKER from BUYER’S
funds at closing.
之前一直都以为我是不需要给钱Agent的，Agent就是从Seller那里拿3%作为
compensation。但是我的这个合同里面好像不是这个意思啊。大家能帮我看看这个钱是
怎么给我的Agent的么？还没有钱合同呢，想了解清楚再签。

但是，签了的话会有什么不好的吗？能不能跟我说一下？
倒是有很多Agent，不过这个Agent是我目前租用的APT的Landlord，一直觉得他很好人
所以就直接用他了。

发帖数: 5191 | 4 这个合同多半都是很传统agent才会要求的, 我想应该是老美, 并且岁数也不小了吧.
这个合同签了以后您在几个月内就不能再随便换agent了. 并且像您理解的,在某些情况
下可能您要付commission给她. | b******i
发帖数: 287 | 5 喔！！ 是的，我看了合同前面，说7月31号之前都要履行合约。是个老美，大概四五十
吧。。。。。。 一开始问了他，现在也不好意思换Agent了。
现在看的合同里面就是好像我要给他钱，所以我就想不懂了。我在版上看回来的信息都
是说Seller给钱Agent的，怎么到我这里就变成我给钱了呢？无端端要给这么多钱，心
疼啊！

发帖数: 5191 | 6 business is business, 在这个时候没必要不好意思. 除非您是非常信任他, 且喜欢按
老美的思维做事情. 否则我的建议是不签.
合同里面说的事情多半是based on一些假设, 并不是真的会让您付钱, 多半都是说如果
seller不付或者只付2%, 那您可能要出0.5%, 等等. 一般您可能碰不上, 但是如果真碰
上了, 这个contract到时保护的就是您agent, 而不是您自己.

发帖数: 731 | 8 Usually it is a standard contract for larger franchise like weichert,
prudential, remax. The essence of these terms is if your agent is a
procuring factor that makes you buy a certain property, then you get rid of
him and you contact seller yourself and buy the property directly from
seller, you are bound by law to pay enen though you end your contract before
you buy. The agent need to establish he shows the house, he presents the
offer, he process other related services to claim that compensation.
If the sale did not go through, agent or brokerage will not claim the
compensation.
I think the agency contract scares people, but we are trainned to have
clients sign this before any showing. By law, that is a right practice but
it really scares people. |
