"buyer to deposit a cashier's check in the amount of $30,000 in a title
company upon signing of this contract. The deposit will be retained by
seller if buyer back should back out of the contract for any reason,
including but not limited to having insufficient funds to close of escrow
within the mutually agreed three-month time frame." You also need to
include clauses to close out the buyer's other back out options such as
inspection and appraisal contingencies or it will be ugly. Three months is
a long time. people change their minds and see other opportunities. Be
cautious no matter who the buyer is.
You may ask your agent to polish the wording but you get the idea.
