First, I'm out a little over $700 counting a lost vacation day and my
homeowners insurance re-issue (it expires end of day on the 18th). I've read
through our various contracts, and this is my understanding (parentheses
refer to sections in the contract):
I am prepared to close on the sale tomorrow July 18, 2014. The buyer is
not prepared to close on that date. Therefore the buyer will be in default
(9.A) by the end of business tomorrow, and I may take the earnest money (15.
) of $2,650.00 (5.) and start showing the house for sale again.
However, having briefly met the buyer, I think she really likes the house,
so I would like to make this work. Therefore I propose:
1. We extend the closing date to no later than July 23, 2014 to allow buyer'
s bank to get their documentation corrected.
2. The buyer agrees that the deposit (section 5 of the Sellers Temporary
Residential Least) is set to $0.00. We will still be out of the house by
the afternoon of August 9, and will pay the $50.00/day agreed to, but this
avoids having to recover the deposit.
3. I will not contribute the $200.00 I offered toward the request for
repairs made after the option period (6.C) had expired. This strikes me as a
fair sharing of the pain for the buyer's bank not completing the
documentation correctly in the almost six weeks since the contract was
