contract要我签字。其中两条我觉得有些奇怪
1. Brokerage fee: In consideration of the services rendered by Buyer's Agent
in behalf of the Buyer, Buyer agrees to pay to Buyer's agent a brokerage
fee of Commission Indicated in MLS. The brokerage fee shall be earned, due
and payable by Buyer prior to the expiration of this Agreement, or within
180 days after the termination of this Agreement. However, if the seller of
the property authorizes the listing broker to pay a portion of the listing
broker's brokerage fee to Buyer's Agent, that portion of such brokerage fee
shall be credited against Buyer's obligation to Buyer's Agent as set forth
above.......
我的问题是，一般buyer是不用付buyer agent任何费用的，我的agent口头也是这么说
的。但这个条款里brokerage fee of Commission Indicated in MLS是指什么？是说
MLS的listing里明确说buyer's agent的commission由buyer自己付，如果没说就是
seller‘s agent付吗？这个是个常规的contract条款还是给我挖坑？
2.说我的agent是Buyer's Agent and Disclosed Dual Agent if the opportunity
arises.
这个和Buyer's Agent有多大区别？是不是只有不是dual agent就可以不去管它？
3.这个contract里有一项Term，说是This agency agreement shall commence on 5/xx
/2022 and shall expire at 12/30/2022...
这不就是说如果这个agent领我看了一个房子，我在年底之前只能通过这个agent买这个
房子？

关键是第一条：Buyer agrees to pay to Buyer's agent a brokerage fee of
Commission Indicated in MLS。
这个是黑条款吗？

看你现在的agent是不是真的有独到之处
第一条我不了解
但是我还没遇到过要求exclusive还能提供真正别人提供不了的价值的agent

这一条也写了，如果seller付，你就不用付。如果seller不付，你才要付。一般mls上
的seller都会付，因为listing agent和他们签的都是包括buyer agent fee了。除非你
买off market，才有可能你付。
你看房时候没让你签，这就说明这个人还不是太push，下offer了还不签，那他就不能
给你下offer。 |

发帖数: 108 | 10 问题出在第三条，这种exclusive霸王条款对买家不利。华人agent很少有要签这一条的。
万一有矛盾，你要半年会才能买房，不然只能用这个agent。

发帖数: 4 | 12 我的经历比较特别。 最早带我看房，下OFFER买的AGENT A 对我最看好的房子拒绝下
OFFER， 没办法， 从REDFIN 上又找了一个AGENT B， 下单， 申请贷款，最后成交，
等等。
AGENT Ａ 带我看过很多房， 如果有 EXLCLUSIVE AGREEMENT， 我还得付给 AGENT
A 一份佣金．有可能我买的房子 是 BANK-OWNED，稍微麻烦些, 他该拿的佣金卖家
还是会给的，他也代理过类似的房子， 但是他就是不帮我下 OFFER。 |

结这个，很正常的费用。

题。这种exclusive压根不是什么霸王条款。你列的三条都没什么问题。 |

买房的时候跟offer 一起下的那个貌似不是Exclusive, 你可以限定在只有下offer 这
个房子
bottom line，你可以改下时间，半年改成2个月 |

发帖数: 3053 | 17 楼上有几个在不同地区买房卖房的？我在康州买房就必须签，在DC地区就没有这种事情
。康州Agent不给返点，而DC地区一般会给1%买家。所以不同地区不同市场。与其在网
上搜集，还不如问问周围朋友同事靠谱些。
