Article 2 Chapter I says:
"All productive activities of fisheries, such as aquaculture and catching or
harvesting of aquatic animals and plants, in the inland waters, tidal flats
, territorial waters and exclusive economic zones of the People's Republic
of China and in all other sea areas under the jurisdiction of the People's
Republic of China shall be conducted in accordance with this Law."
There are also various regulations on fishing, hunting, forest, and
agriculture.
China has laws, but the enforcement of law and people's attitude towards
laws are the real issues.
It is wrong to assume that fishing has never been regulated by the state in
China. Even in ancient times, there were regulations on finshing and hunting
. We can even see that in Zeng Guang Xian Wen.
Law evolves with the society. For many years, prostitution was legal in
China, but not anymore, even though prostitution is common and it is hard to
enforcethe law.
Also, that a man does not know the law is not an excuse for violating the
law.

小学的时候还组织四个班去河道里野炊。吃完饭之后就有人说两点要开闸放水,大家就
赶紧撤了。不知道他们怎么通知到的,那时候还没有手机。

s*****r 发帖数: 11545 | 17 Yes, as I mentioned in a previous post, it is required by law.
I am not saying that the victim deserved death, but someone mentioned his
legality in fishing and I happen to be interested in this topic.
I agree that there is no such a default rule spelled out, but everybody has
his own understanding. Personally, I will assume that a person does not have
such a right to catch fish. I will also assume that every thing has an
owership issue and I am not automatically entitled to it. Besides, the
government can regulate virtually everything.
