Live. It was suggested by one of the children that killing all Chinese would
solve the debt problem for the US, and EVERYONE including the adult host is
laughing about it. The host even commented that "This is interesting!"

It is totally unacceptable. Jimmy Kimmel and the ABC network should know

Boycott abc， fire Jimmy Kimmel 在本质上是一种命令。假使你是一个白人／墨西哥
人／黑人，没有看过Jimmy Kimmel 的辱华节目，有着和CNN， Fox 一样的对中国的负
面价值观（人权，西藏，维吾尔，贩卖人口，器官交易）。你觉得他／她会care 吗？
世界上所有成功的民权主义者都是以将心比心方式和非暴力的方式达到目的的，比如曼
德拉，甘地，当然还有阴险的达赖。只有爱才能够唤起爱和同情。
同时也希望以成功的华人牵头成立一个大中华人权基金会（中国大陆，台湾，香港，新
加坡）。基金会接受普通工薪华人捐款。基金会的钱可以用在以下方面：
1. 在政界培养代理人。
2. 捐钱成立或支助智库（think tank）做研究，把舆论向有利于华人的方向引导。
3. 在出现辱华／针对华人的仇恨事件时，一定用法律手段打赢官司。这个只有基金会
才有财力办得到。陈国仁在1982年被美国白人用棒球棒活活打死，凶手交了2万保释，

去年10月19日，华人华侨在白宫网站发起请愿，要求“请立即掐掉那档节目并发布正式
道歉”（“Please immediately cut the show and issue a formal apology.”。其
中并没有要求开除吉米的内容，英文全文见附录）
这个请求并没有明确说明要求谁掐掉节目并道歉，不过可以理解为是要求白宫（美国联
邦政府）这么做。
近日，美国白宫就此作出了回应。
第一段，讲述了道歉的要求早已经被实现，而且ABC电视台已经修改了这档节目（永久
性地取消肇事的“儿童圆桌会议”）。
第二段，重申了去年在回应中央电视台时白宫发言人的声明，就是美国政府认为吉米鸡
毛秀中出现的言论不代表美国对中国的主流看法。也重申了美国乐意看到中国和平崛起
的观点。这段也相当于回应了白宫无需为自己不认同的言论道歉的立场。
第三段，回应了“掐掉那个节目”的要求。那档什么节目？“儿童圆桌会议”早就被
ABC电视台取消了，显然无需再取消一次。第二种可能，那档节目指的是吉米鸡毛秀节
目。
白宫明确表示“美国联邦政府无权强迫ABC电视台去掉那档节目（吉米鸡毛秀）”。这
是正确的。即使那个小孩说要杀掉奥巴马或国会议员以解决美国国债问题，白宫也是无
权强迫ABC电视台去掉那档节目。美国不是中国。即使白宫认为某个媒体涉嫌犯法了，
也只能通过法律途径进行诉讼。以前《纽约时报》不听军方劝阻执意刊载越战机密文件
，美国政府也是通过向法庭起诉来维护自己的要求的，而非下令关闭《纽约时报》。不
是白宫（美国政府）不想这么做，而是无权这么做。
为什么无权？
白宫在回应的第三段中写明了：美国宪法第一修正案规定保护言论自由。和大多数中国
人所理解的不同，这里的宪法条款是规定美国政府不得干涉言论自由。小孩说杀光中国
人，网上声明炸白宫，电话表示杀奥巴马是不是言论自由？法律是标准，法庭是判官，
而不是白宫。越战机密文件的案子，美国政府最后输了，《纽约时报》赢了。
所以，在美国宪法的规范下，美国政府（白宫）无权强迫ABC电视台去掉那档节目，也
就是明确说，这个要求无法满足。
第四段，给出了咨询意见：如果还不满意，可向独立的美国联邦通信委员会提出申诉。
回到这个事件的本身，事实上，节目主持人杰米是被冤枉的。因为他吉米并没有赞同小
孩“杀光中国人”的说法，他不但数次正面引导小孩，而且最后明确指出这是荒唐和血
腥的说法。
中国刑法规定：故意捏造并散布虚构的事实，足以贬损他人人格，破坏他人名誉的构成
诽谤罪。
2013年9月9日，“两高”规定，利用信息网络诽谤他人，同一诽谤信息实际被点击、浏
览次数达到5000次以上，或者被转发次数达到500次以上的，可构成诽谤罪。
上街举牌将吉米丑化为希特勒的人，要是在中国就是诽谤罪了。
吉米是个铁杆左派，他以讽刺和嘲笑国会议员（特别是共和党议员）出名。大街上吉米
被丑化成希特勒的画像，满道路的吉米鼓动杀人的标语口号，显然污损了杰米的公众形
象。不过，心中委屈的吉米即使想控告那些华人华侨诽谤，美国社会和法律不会支持他
，因为大家会说：那是言论自由，是中国人在表达心中的愤懑。
什么是言论自由，美国和国际社会已经有了比较清晰的界限。一些网友搬出的联合国人
权条款和国际法，认为ABC节目是煽动种族仇杀。但那些条款说的很清楚，指的是“
direct and public incitement to commit genocide”。一个6岁学龄前儿童叫嚣“杀
光中国人”并无现实的威胁。地球那边中国人不是犹太人，也不是美国的黑人。中国已
经是世界第二强国，除非美国突然发动核袭击，无人能杀数亿中国人。而美国政府或军
方显然不可能被一个小孩忽悠而发动核大战的。这与煽动，威胁烧学校，杀某领导人不
可同日而语。

I was very disturbed by Jimmy Kimmel’s ‘Kids Table’ show. It was aired on
ABC recently and talked about killing all the Chinese so that the states do
not need to pay back their debts to China. The kids might not know anything
better. However, Jimmy Kimmel and ABC’s management are adults. They had a
choice not to air this racist program, which promotes racial hatred. The
program is totally unacceptable and it must be cut. A sincere apology must
be issued. It is extremely distasteful and this is the same rhetoric used in
Nazi Germany against Jewish people. Please immediately cut the show and
issue a formal apology.
