中美贸易战爆发后，中国很快向WTO提出申诉，指控美国的对华关税不符合WTO规定
。然而，WTO认定中国市场封闭的态度，令中国政府备受打击。
WTO批评中国的市场依然封闭
7月19日报道，世界贸易组织（WTO）当地时间7月11日在设在瑞士日内瓦的总部，
公布了以中国为对象的贸易政策审议报告书，指出中国政府援助国有企业及限制外国企
业进入等，持续干预经济活动，市场仍处于封闭状态。同时，也批评了中国泛滥的知识
产权侵犯行为。
在中美贸易摩擦7月6日开始急剧升级的背景下，WTO的这个观点，无疑对要求中国
进一步开放市场的美国特朗普（Donald Trump）政府非常有利。而对于打算通过WTO抵
御美国制裁的中国来说，必然造成极大的心理冲击。
据悉，WTO的报告汇总了2016年至2018年3月的数据。其中指出，中国继续发挥着牵
引世界经济的作用，但增长速度放缓，中国政府也在致力于把重点“从增长的量转为质
和持续性”的经济结构改革。
另一方面，报告指出，农产品和矿产品的交易由国有企业承担并施行价格管制等，
是“政府在深入干预经济”。认为中国政府虽然向高新技术、知识密集型产业、渔业等
提供补贴，但有关部门未提供充分信息，实际情况不明。
此外还称外国企业的进驻仍然遭遇中国的很多政策壁垒。关于中美贸易摩擦原因之
一的知识产权侵犯，报告认为虽然可以看到中国加强取缔的努力，但知识产权保护的相
关法律未有大的更改，改善仍不充分。
关于被国际上视为较高的关税，报告称到2017年12月为止，中国的平均关税率为9.
3%，较2015年略有下降，但没有就其高低置评。
有分析指出，中国被认为只有依靠WTO的帮助，才能在对抗美国的贸易制裁中避免
更大伤害，但WTO的上述说法，无疑对中国不利。
英国广播公司（BBC）7月19日报道称，中美贸易战正式开打后，中国7月6日和16日
先后两次，在WTO就美国对华“301调查”项下的征税措施追加起诉。
香港大学经济及工商管理学院副教授陈衡对BBC表示，诉诸WTO反映中国没有方法应
对这场贸易战。
他说，中国为美国征收关税一事到WTO打官司，就好像是“两个小孩在公园吵架，
打不赢的一方，要找老师、找警察”，但事实上效果不会特别明显，因为WTO裁决也难
以左右美国的政策。
而如今WTO认同美国对华观点的说法，无疑会对中国对抗美国上造成更大困难。 |

Although trade defensive instruments are legitimate measures within the WTO
framework, many Members stressed, once again, that the United States was a
particularly active user of anti‑dumping and countervailing measures,
that certain methodologies applied by the United States were disputed, and
that the continued extension of such measures in many cases were perceived
as unwarranted. The United States explained that, as permitted under WTO
