your overly broad question:
Personal bankruptcy, depending on Chapter 7 or 13, will totally or partly
relieve you of your debts. Most likely your credit history will be
destroyed. You will have to say farewell to credit cards for some time and
build your credit gradually. Some employers take issue with a bad credit
history, but not all do. Your spouse or children's credit will not be
affected. However, your spouse's income and expenses will be taken into
consideration in determining your eligibility to file bankruptcy. |

in the Bankruptcy code. The law also has mechanism to deal with fraudulent
conveyance. Generally it is not easy to get away.

owes money to the credit card company. The goal of the bankruptcy is to
discharge the debt (Lai Zhang). So do you think the pissed-off credit card
company will let you use their service again soon? Even if you don't owe
money to a particular card, the devastation of your credit will probably
prompt the company to cancel you card.

a total devastation. It provides individuals with a fresh start. Some states
(e.g. Texas) provide very high limit for exempt properties (e.g. House).
So, with good planning, you can convert your asset to exempt property, which
you can keep after bankruptcy, and use bankruptcy to get rid of a lot of
unsecured debt (e.g. credit card debt). Many millionaires file bankruptcy
while they keep living a good life. |
