seller has to do the repair and treatment, otherwise, you will not able to
get mortgage.
Sellers will never reject your request for termite repairs, so might be hard
to get out of contract with this reason. You can use other inspection
issues to walk away.
Well,in NJ most of the houses are in a wood area, and it is hard to find a
house without termite, unless you buy a new construction.
You can hire a pest control company come to check the home once a year. It
probably will cost about $80 or $90. When you sell the home show the pest
control record to the potential buyers, it will not affect the reselling of
the home.

maybe to some educated buyers, the effect is limited.
but I guarantee you will lose a substantial portion of would be buyers.
For example, your interested group could reduce from 10 to 4. (Those 6 that
were scared away by your termite situation may later be more tolerant. 6
months or 1 year later, they could turn into someone like those original 4.
but as a seller CAN YOU sit on 6 months or 1 year?)
those 4 looking at your home are also seeing other houses. all things being
equal, you think they will pick one with termite problem, or one without?
Still think it will not affect the reselling of the home?

If you definitely want to walk away from the deal, do not put down the 2nd
deposit. Your attorney also should not tell the seller attorney that you
want to walk away because the termite issues.
What you should do is keep negotiating on other inspection items until the
seller reject you request. At that point, you attorney can cancel the
contract.
