买房第一次给offer,broker说要递offer必须同时交1000块定金,如果最后没成交,会
退回来。是这样吗?以前在别的地方没听说有这规矩。

这1000定金,不一定使bank check. personal check 也可以。如果,offer接受,再买
一张bank check就可以了。

$1000只用image就行了,达成deal后,和5%deposit一起交到你的律师那。

其实如果能成交的话,早交晚交无所谓,只是有点担心是broker捣鬼,就算这房没买成
也拿这钱拴住我,可能是我想多了。

随便一张支票或复印即可,卖方不会兑现的。

我记得好像是说,合同签后3天还是5天,过了这个时间,定金就拿不回来了?还是我记
错了?

我们不是很清楚,但是我们也是给过offer,现在在等loan,但是我们没有给那1000。
inspection之后,同意要了,是给了对方律师10%的押金,然后开始贷款。

Good Faith Deposit,offer没接受会退给你的,如果offer接受了签合同后,这钱可以
算在首付款里。

這個一千塊, 就和雙眼正視,緊緊握一把手一樣, 表示有誠意
所以叫good faith deposit.
以前全國都用。是個老習慣。
大多數時候, 支票在agent辦公室裡滾一下copy machine and goes into a file.

If the deal doesn't go through, the agent would either
1) return it to whoever wrote it (deemed the best choice)
2) or destroyed at writer's request or permission
3) or tell the buyer we will keep this check for your next offer, just reuse
it as good faith deposit. (An attempt to hold on to this buyer)
If the deal was successful, then of course the check will come to the
closing table as credit to buyer....

The trouble of course would start when you have customers checks in the
office.
Some of them grew legs.
Even more grew wings.
Most of those checks almost never go to bank, but got lost or misplaced all
the time.
Even when they got deposited (which is a safer and preferred way), they don'
t always go to the right accounts.
Sooner or later, every state cracked down on this practice. Demanding
brokers set up escrow accounts and specified a short period of time within
which the agent must deposit the check into the right escrow account.
Things would've been okay if every deal went through. But majority of deals
didn't proceed as wished. Returning that check became a night mare. Because
it's extra work for the brokerage and they don't gain anything out of
handling these checks.

To make things even worse, state RE commission took this up as consumers
rights protection issues.
Depending on states, The aforementioned short period of time is usually 3-5
business days. After that, if a good faith deposit check is found sitting in
a folder, the agent and the broker get fined.
State Commissioners send enforcement teams going to brokerage, and search
cabinets, drawers and every folder, looking for such checks and issuing
fines.
inflation raged on too, in most affluent communities, $1000 is becoming less
and less significant, its business weight turns lighter and lighter, but
its administrative and legal burden became much too heavy.
So some broker smartened up and finally said, no more good faith check.
Forget the checks. It used to be real money, nowadays neither buyer or
seller treat a thousand bucks as something could play any role in the grand
scheme of buying or selling a piece of real estate...

Well kids, this is the world you entered and this is what you are accustomed
to.
.
That's why, if some brokers or sellers demanded the old fashioned good faith
check, we will see " 买房给offer还要同时交定金?" Well, that used to be the
norm.
If the state commissioner didn't fine brokerage insane penalties, then maybe
everyone would still be writing this $1000 check now.

只有买家在没有任何原因的情况下,合同已签,at trendy review 已经完成,home
inspection也满意的情况下,不想进行下去。这1000 可能会损失。不属于上述情况,
可以也应该退回,不然可以到county superior court去file lawsuit,自己可以做,我
也帮我客户在 Monmouth county 告过一家棒子,把钱要了回来。
