他过海关的时候拿着我们给写的邀请信，邀请信里面有我老公的电话。
他被带进小黑屋以后，海关给我老公打电话说的。 我老公当时也有点蒙了，也没说说
什么好话，也没问具体原因啥的。就告诉我说海关电话里很强势，说必须19天离境，一
年内不准再回来。

他们没有给出具体的理由，我们自己猜测可能是因为频繁。
可能也是因为我们没有违法，所以海关给的stamp还是半年，但是口头要求19天离境。
今天中午去机场找海关的office问情况，但是周末没开门。会接着更新。
PS：
移民官工号我爸没记住。不过你提醒了我们，下次应该记住这样，到时候不管找人还是
投诉，都容易一些

我今天跟老公又去了一趟sanjose机场旁边的海关办公室问了一下，一个officer明确给
了答复说以i94为准，不用19天回国，可以年底再回国。
但是他同时也警告说b1/b2是旅游签证，我们这样情况的trip history很不好，下次来
要间隔时间长一些，不然移民官会觉得我爸是居住在美国，而不是居住在中国。

可能是因为频繁，他这是第三次来，之前每年来一次，每次都是五个多月。
入境章就是昨天，给的离境章还是给满了六个月。但是给我老公打电话，说是必须19天
之内离境，还说本来打算吊销他的十年签证。
我们后来给客服打电话，客服说一切以i94为准。
我们现在也拿不准。 |

每年都是在在美国呆五个半月，在国内呆六个半月。从来没有申请延期或者违反规定过
。

发帖数: 157 | 18 Thinking out the box, I would suggest two actions in additional getting help
from a lawyer:
1. Work with your Dad to reconstruct the process as detail as possible
and keep all relavent evidence, what the immigration officer (through
translator) asked, what did they write down, etc. Consult a lawyer (or
lawyers) to evaluate if there is any wrong doing on the immigration office (
or translator) side. If yes and you can make a strong case, sue the
immigration office and seek compensation – there probably will be
lawyers to take your case free of charge as far as you agree to give some
percentage of compensation to the lawyer if and when the compensation is
granted.
2. Regardless the outcome from the above, you can do one thing for sure:
contact your local congress person and senator’s office. State what
happened, express you concern (or angry) that your visitor’s trip was
disturbed and you are unhappy with the immigration office at airport. Ask
the office to request a formal response from immigration office to explain
the event – why they take your Dad to question him, what did they do during
the process, was the immigration office
polite, etc (dig into detail, more details more work).
Some thought behind these actions:
1. The immigration office’s mission is to prevent illegal entries and
filter out some safety threats – not to disturb these normal visitors – at
least they should try their best to minimize the disturbance. I assume
your visitor had all legal documents for the current entry and past
extentions, thus there is no sound reason to disturb your visit's trip. In
some sense, the immigration office was abusing the power to pick your
visitor – don’t know the exact reason, maybe the immigration officer just
felt boring at that moment and you visitor happened to come into their eye,
or whatever a reason. It is just that the visitor (your dad in this case)
is
powerless facing the immigration officers, so some immigration officer may
feel they can do thing their way without much consequences. That’s right,
however,
2. Don’t forget the visitor’s sponsors (in this case, you, who invited
your dad to US) are not powerless facing the immigration officers. Assume
you come legally, pay your tax (which at least partially funded the
immigration office) every year, you have the right (through your congress
person office would gain more weight) to inquire the immigration office
about what they have done, particular to your visit. So even if the
immigration officer has stayed in the line and you have no base to sue. OK
let’s be fair, you can disturb my visitor’s trip, I can at least make you
work more (or get your in trouble if I can), write a report to the congress
person’s office. Think from the immigration officer’s point – would he/
she like to just go back home after work, or to stay late for these kind of
extra things if the immigration office get pressured?
Would the congress person’s office be motivated to involve in this –
should be. This is the best case to show the congress person cares taxpayer
and without offending anybody locally where he/her vote come from. The
immigration office is far away from the vote base – a good target! Once
the immigration office in airport learns that you, who are not in a
powerless position, are watching and acting, it will be different. |

Forget the phone calls, and tell them send a letter for the 19 day departure
requirement, if they call again. Sound like a hoax - everything from
immigration should be in writing to take effect. |
