发帖数: 12 | 1 Just got an email from my lawyer saying my I-140 is approved. Some of you
might remember my postings about the I-140 RFE. Here is my journey:
Petitions submitted in Mid August, Receipt dates at NSC are Mid September,
submitted Premium Processing Request for I-140 right after we got the
Receipt Notice. Received RFE within 3 days, RFE received by NSC on October 1
, I-140 denied on October 2, and of course I-485 was denied as well.
We were in total shock after the I-140 denial because Schedule A I- | w********n

I do not know if I will use it or not. I think my case is in NSC.
By the way, what kind of REF are needed. It seems to me that we have
prepared everything needed for the application.
I do not know, if my case was denied, what is the priority day and can we
submit I140 and I485 together or not. It is a big problem these days.

发帖数: 12 | 4 My RFE is for notice to the bargaining representative since my hospital has
a union. We did include the notice in our original filing. But obviously
what we submitted is not what the officer wants to see. If a case is denied,
a new I-140 can be filed but I-485 can not since there's no available visa
number. My lawyer said if a case is reopened and approved, the priority date
is still the receipt date.

发帖数: 2269 | 5 NSC really likes RFE. Some people at immigration board said that about 80%
will get RFE. Any way, what is your RFE for? The reason to deny your RFE?

in our RFE we submitted again the notice to the Union Representative. And
yet the reason to deny my RFE is still "Failure to notice the bargaining
representative". So who knows if the officer just didn't see the document,
or didn't think the document is indeed the notice, or the notice is not the
format they like. For the MTR, the hospital wrote

发帖数: 46 | 9 Although I got my GC already, I even don't know what means RFE and premium
process. As far as I know, USCIS do not process the documents they didn't
ask for.
