No, it is a misunderstand. Actually if you fied I-140, your J1 visa will not
be affected. If you file EB1 and het approved, you will receive green card
in 3-6 months, you need get J1 waiver.
If you file EB2-NIW, it never affect your J1 transfer.ABout EB1 and EB2-NIW

EB2-NIW takes very long term to final receive your green card, for example
if you filed your NIW in 2004, you need to wait 30-40 months to receive GC
if you filed your NIW in 2005, you need to wait 40-50 months to receive GC
if you filed your NIW in 2006, you need to wait 50-60 months to receive GC
if you filed your NIW in 2007, you need to wait 60-70 months to receive GC
The later you filed your I-140, the more time and more money you wasted, the
more difficult you will face. So, file your I-140, the sooner, the better.

My colleague applied for J1 waiver in October 2006, she returned to her
country to take a vacation in December 2006, she backed to USA in January
2007, she never met any J1 visa trouble even she filed J1 waiver.

supposed that I will submit the I140 at the begining of the next year,
if i need to go back to china after i submit the I140, is it difficult for
me to go back USA due to the J1 visa?
also,if want to apply for EB1b, do I need to transfer J1 visa to H1B?

in your university.
For EB1b, you still need to pay all money and prepare all documents and 6-8
recommendation letters, the Department chairman(or Human Resources) just

old one expires. I think some people may be confused by the terms 'visa'
and 'status'. We can keep J1 status as long as the DS-2019 is valid. Visa is
the stamp in one's passport which allows him/her to enter the U.S.

could you explain it to me? I do not understand that why I will have
trouble to obtain a a new J1 visa, now I am J1 visa, why I need a new one? I
hope when I have opportunitiy, i can transfer my J1 to H1b.

tranfered J1 visa 3 times in USA, nobody asked me whether I filed I-140, and
I got new DS-2019 smoothly. If I left USA and took a vacation to China, I
am sure it would not affect my new J visa.
I would not take any risk to back to China if I knew I could be rejected my
J1 visa.
