司打工。和老板说了情况后，老板竟然说愿意帮忙我申请H1B, 可是H1B就算现在申请也
要到10月份才能生效，当中有4-5个月的GAP必须回国。这样老板估计就不愿意搞H1B了
，有什么可能想办法在这段等待时间里有有效身份等待h1b呢？
还有LG是加拿大公民，没有2年回国居住的要求，但是我是中国护照，签J2的时候，面
试官勾了两年居住的要求。这样的情况下J1没有WAIVER的要求，J2需要WAIVER么？

number see top 1 post from this board.
It looks without his J waiver, you cannot file H1B, or he get DOS advisory
opinion showing he is not subject to 212(e). |

请了呢？
豁免申请是不是只有j1能交，j2是不能单独提交的？那我们这种情况j1没有居住要求，j2却有，那应该豁免申请交给加拿大使馆呢，还是中国使馆？
是不是所有的中国护照都一定有居住两年的要求，不管j1是什么情况。。。 |

请了, It is true.
豁免申请是只有j1能交，j2是不能单独提交, it is true.
When your LD got J visa 2-3 years ago, if he was a Chinese citizen that time, he needs to submit to Chinese Embassy.
If he was a Canada citizen that time, he needs to submit to Canada Embassy. |

关于我的J2需不需要WAIVER的问题，后来我认真查了dos的网站
发现他们有个电邮地址 f******[email protected]
我先发邮件询问了我的case，他们回信如下
Please be informed that the initial determination of 212(e) subjectivity (
made by the U.S. consular officer at adjudication) is not always accurate.
Therefore, we advise that you obtain an official advisory opinion from the
Department’s Waiver Review Division in order to determine whether you
indeed “not subject”. Please visit their website at https://
j1visawaiverrecommendation.state.gov/ and undergo the online application
process found there.
我从他给的连接下载填好了需要的表格，同时会生成一个case no.加上护照复印件和两
个人DS表寄到DOS 华盛顿的地址。等他们收到后就可以online check 你的case status了
过了2个月的时间，总算得到了DOS的回复，结论是"not subject to 212(e)"
现在我已经顺利收到H1B approval回美上班。
