现在是学术界的postdoc,打算最近换工作,还是在学术界h1b, 这种情况可以直接拿
到 h1b transfer 的 receipt 去新的单位上班吗?不然就要等 是你的h1b approve才
行,就得等好久了。
看到有人说公司可以 transfer receipt 上班,不知道这个在学术界是不是一样,

Long answer:
1. ALL H1b petitions follow virtually the same process. Doesn't matter if it
's "academic" H1b. The only difference is that higher-education sponsored
H1b are cap exempt. You still follow the same petition process.
2. Given that you are a current H1b beneficiary, in the case of changing
employer, your new employer files for a new h1b petition on your behalf. You
can start working as soon as you receive the I797C receipt notice from
USCIS. However, there is a 240-day rule (you can work up to 240 days using
receipt prior to approval) and you may be subject to this rule--you should

结论是:法律上拿到 transfer 的 receipt 开始工作完全合法(操作起来可能要注意
申请文件上的起始时间、前一份h1b 工作还在等等),但是具体到各个(学校和科研)
单位可能会要求 approval 之后才可以上班,为了他们自己的利益(比如,万一
transfer 不批准的话,他们不是还得重新招人等各种麻烦)。
