我们刚下了一个房子的offer,现在卖方给我们的counter-offer有这样的contingency:
Sale to be contingent on successful, concurrent close of sellers purchase.
Close of escrow to be concurrent with sellers purchase. Occupancy to be
COE + 2 Days (5:00 pm). Escrow to be XXX. Title to be YYY.
Home inspection to be performed within 9 calendar days of Acceptance.
Appraisal to be ordered within 9 business days of Acceptance.
Contingencies (including loan) to be removed within 17 days of Acceptance.
然后在C.A.R Form COP上选了"Seller's purchase of replacement property"
Seller shall, within 19 days after Acceptance, remove this contingency or
cancel the Agreement. If Seller does not remove this contingency in
writing within that time, Buyer, after giving Seller a Notice to Seller to
Perform(CAR. Form NSP), may cancel the Agreement in writing.
请问我作为买家,这样的条款可以接受么?我的理解是过了19天之后,没有了Purchase
of
replacement property的contingency,就可以按正常的escrow的程序走,不会出现托很
久的情

有两种可能:
1. 过了19天,卖家remove this contingency (To be valid, it must be IN WRITING
): "Seller's purchase of replacement property", escrow按正常计划进行。
2. 过了19天,卖家没有remove this contingency IN WRITING: "Seller's purchase
of replacement property",而是 cancel the purchase agreement, escrow立即终止。
还有一定要小心:Occupancy to be COE + 2 Days (5:00 pm).
After COE, you are the owner of the home, the seller are the renter of the
home during those 2 days, they must purchase rental insurance to protect
their personal property in case there is a fire or flood damage during those
two days. you should demand that.
In addition, you should have home owner's insurance to protect your personal
property effective immediately after COE.
