。气不过自己亲自做了一下，发现同样的活只要化1／4的时间都不到。明显他在
overcharge bilable hr. 能上court 去argue 吗？

发帖数: 368 | 7 I do not think you really have grounds. If you agreed with the contract at
the very beginning, you agreed with the time allocation and hourly rate.
You can go after fraud, but on what? Character is not to be punished,
unless it is for tax and regulation issues, especially he is a contractor.
You can argue with the % of fulfillment, e.g., instead of 50%, you can say
his work is only 25% finished.

发帖数: 368 | 9 It depends on how your contract read. In your case, try to interpret it
more towards project basis, e.g., the whole project is estimated 100 hrs and
cost 5k. The deliverables are A,B,C and D (or milestones). If he finished
A only, that is 25% (or some reasonable #) and your cost will be 1.25k

If you find him through an agent/website etc., you can use them as a
mediation venue. You can leave feedback as well.
How did he work for you?
If he sat in your office/home office and idling, you still needed to pay him
for his hours as it was your obligation to monitor and coordinate his
progress (but you certainly have the right to terminate the contract given
such provision in your contract).
If he sat in his own office and idling, it is more project based than hourly
based and you can gain more ground in justifying with %fulfillment.
How your contract read?
This is the most important thing to prevent this thing to happen. If it
were project based, you only pay the portion according to fulfillment
regardless how many hours he used as both of you agreed forehead the
milestones and rate (even if it showed in hourly basis). | c****u

个consultant 故意把活停在那儿想再勒索我一个新PO，气死人了。$120/hr 的rate,
干活还的我来教。最后还是我亲自动手做完的活。不fight 到底咽不下这口气。
