valid and there was no finding of obviousness. Damages: Running Royalty
based on 3.5%. Jury awarded $30 million in damages covering all defendants.
It sets up for Judge Jackson to use that figure for future royalties. My
guess that the total all-in to Vringo is going to be $550-$600 million.

that Internet giant Google and several other companies infringed on its two
patents.
The jury decided that the payments of royalties on the infringed patents
should be running, which means the companies would have to pay what’s owed
in future years until the patents expire in 2016.
I/P Engine, a subsidiary of the cell phone ring tone company Vringo, owns
the patents and sued Google and several companies claiming they have been
using the technology in those patents without permission.
The jury ordered Google to pay $15.9 million, AOL to pay $7.9 million, IAC
Search & Media to pay $6.6 million, Target to pay $98,800 and Gannett to pay
$4,000.
The infringement award is far lower than what Vringo had hoped going into
the trial. The company had sought nearly $500 million in damages for annual
infringement dating back to 2005.
But U.S. District Judge Raymond A. Jackson limited damages to just the past
year, ruling that the patent owners should have sued back then to collect
for all those years.
The jury decided on damages using a formula based on the companies’ annual
revenues.
Lawyers for both sides declined to comment.
