Good news is that there is no IRS publications explicitly diallow your
claim of income tax exemption.
There maybe internal documents with IRS inteprete the tax treaties.
I called IRS and at first they told me that I cannot claim the benefit
as H-1B holder with F-1 before unless I go back to China for one year and
come back with H-1B. Then I asked them why "one year" not six months.
