个知识误区。而且才知道像我父母的这种情况,是不能报联邦税的。
1. 父母如果没有美国绿卡或是美国公民,只是持有B2签证的话,如果是来自几个国家
像加拿大等等,是符合条件的。如果父母的护照是来自中国的话,又持有B2 visa,是
不符合条件的。
2. 另外一个183天的问题。父母不需要在美国待满183天也能符合报税的条件,只要符
合上面那个条件。而且你有证明你寄钱回国去支持父母的生活,就可以。
3. 为什么我们在报税的时候,把父母的ITIN申请同时交上去也能得到批准。是因为税
务官假定你是知道以上两个规定的。如果申请了父母的税号而且也用来做到自己的Fed
Tax Return的话,IRS照样会按照你申请的情况来处理。但是IRS保留了audit的权利。
申请绿卡时,如果要submit过去三年的Tax Return的话,也会有风险。

local IRS and was not told the info you provided. I've also been dealing
with government staff and always get conflicting/opposite answers when I ask
the same question.
To pass substantial presence test (183 days rule)

it does not have the "regulations" you mentioned. Either IRS staff is wrong,
or IRS needs to update its 1040 instructions. |

如果需要IRS解释,请给IRS打电话,ask for a tax expert,IRS local office没有足
够的能力和解释权
不要为了退税把问题复杂化,individual audit的可能性不大,但是万一被audit会相
