my friend is changing her status from J2 to H1B, can she have a tax
deduction for application fee of changing from J2-H1B on her tax return?
What about the college tuition she pays for her son?
thank you! |

t*********c 发帖数: 92 | 3 Thank you! but I found another answer for Q#2 from the irs website
here is it(see below), I guess my friend can't deduct the college tuition
she pays for her son since she is holding a H1B status and is married filing
separately. Welcome for response if anybody find me wrong.

Who Cannot Claim the Deduction
You cannot claim the tuition and fees deduction if any of the following
apply.
*
Your filing status is married filing separately.
*
Another person can claim an exemption for you as a dependent on his or
her tax return. You cannot take the deduction even if the other person does
not actually claim that exemption.
*
Your modified adjusted gross income (MAGI) is more than $80,000 ($160,
000 if filing a joint return).
*
You (or your spouse) were a nonresident alien for any part of 2009 and
the nonresident alien did not elect to be treated as a resident alien for
tax purposes. More information on nonresident aliens can be found in
Publication 519, U.S. Tax Guide for Aliens.
*
You or anyone else claims an American opportunity, Hope, or lifetime
learning credit in 2009 with respect to expenses of the student for whom the
qualified education expenses were paid.

Depending on her tax bracket, the former option could be better.
