I have a few questions about tax filing and ITIN application:
1) can I submit W7 for ITIN application and 1040 separately, or do I have to
submit W7 and 1040 together? I want to make sure to get ITIN first before
file 1040 if doable.
2) For Tax year 2007, I submitted W7 with 1040 together for my parents-in-
law. Only one person got ITIN and the other didn't although they came and
left together. This is definitely an error at IRS. Thus our tax filing was
modified and we didn't get tax deduct for one parent. Is the form 1040X the
correct form to get the mistake corrected?
3) What is the best way/sequence to file 1040X for year2007 and 1040 for
2011? i.e.,
W7 for ITIN -> 1040X for 2007 and 1040 for 2011
W7 for ITIN + 1040X for 2007 -> 1040 for 2011
W7 for ITIN + 1040 for 2011 -> 1040X for 2007

file 1040X for 2007. I might be wrong, but it's very easy to verify this
either by checking it yourself or contact IRS help line.
Most of the information I checked here recommended to file W7 and 1040
together. You should not worry about IRS mistake. You should just submit
what you believe the right form and make argument later on if they will make
that mistake again which is highly unlikely.
for 2007 tax, they made a mistake and you made a mistake as well by not
pointing out their mistake. |
