After you get F-1 visa, you become "NR".
In 2011, your number of days as "resident" is 183 days (let's say your J1
was till June30of 2011). You meet the substantial presence test for 2011.
You are resident for tax year 2011.
You cannot claim F1 tax treaty because your F-1 visa was not obtained in China.

| s*******u 发帖数: 241 | 4 wait, if you came here in 07 and I assume you were J-1 scholar (rather than
student), you would have become resident in 09 already. Because you can only
be exempt from the substantial presence test for the first 2 calendar yrs.
But in any case you were J-1 students, you can be NR for 4 yrs. so in any
case you would have been resident since 2011.
Please correct me if I was mistaken...coz I am trying to figure out my own
status as well!!

period". Can I count those two months as my J1 status? Actually I didn't
get my F1 approved until late Sept, 2011.

FYI:
If you keep F-1 from Sept 2011 on, you are NR for 2012 tax year.
0(for 2012)+6/3(for 2011)+12/6(for 2010) <183 days. You dont meet
substantial presence test for 2012 tax year.
