Use Tax
Virginia's consumer's use tax is a tax on goods you purchase if 1 of these
is true:
The business didn't add Virginia sales tax to your bill.
The goods you purchased were tax-free while outside of Virginia.
Use tax is applied to all goods other than magazines or newspapers.
You have to pay use tax on purchases if both of these are true:
You didn't pay sales tax.
You made the purchase through 1 of these:
Telephone
Internet
Television
A source outside of Virginia
Mail — if the total is more than $100
You don't pay use tax on these purchases:
Nonprescription drugs
Proprietary medicines
Medicine for the cure, mitigation, treatment, or prevention of disease
Medicine for human beings
The use tax is based on the cost price of the item. For non-food items the
rate is 6% for Northern Virginia and Hampton Roads areas, and 5.3% for all
other areas. The use tax for food purchased for your home is 2.5%.
The cost price doesn't include separately stated shipping or delivery
charges. It does include shipping and handling charges if listed as a
combined item on the sales invoice.
